innocent killings...?

Ok, I'm cruising to a station. Ships come in triggering red alert.
I wait till they draw first blood...
...then I take them out...!
I go to the email and I find out that 'one was an innocent kill', no credit.
The ship shot and hit me first...! ...and...?

It all depends on what the status the target ship had when it was destroyed. It may very well have shot first, but if there were no police ships nearby it probably wouldn't have been changed to "Offender".
What I often try to do with these scenarios is, when they start firing, to try and position the station between my ship and theirs. Accurate shooting is usually not their strong suit, and if they hit the station they will instantly become an offender.

If it's red on the scanner, it ain't innocent. Kill 'em all - it's the only way to be sure!

Which is true for you also. This is a game rule under the "equal rights for the NPCs" theorem.
