In a sense this is what we now have. Oolite 2 as a project was abandoned some time ago as the whole thing just got out of hand with some crazy 'wish lists' constantly distracting from the main discussion. However the main thrust of Oolite 2 was the change to Griff ships, and this has now been done, and many of the other proposed features are now in the game or in the pipeline, so in all but name what we have now is Oolite 2.

Although there's always the risk that, if Oolite came to be seen as an alternative, as opposed to a homage to the original (and to some extents an advert for E:D), then FD might be tempted to bring the hammer down on it.

It's worth remembering here that despite the similarities in genre and gameplay there's virtually nothing concrete in Oolite which is actually a copy of Elite. There are some text strings which have identical values to corresponding strings in Elite - "Viper" or "Reorte" for instance - but those could be replaced without affecting gameplay if they were considered significant enough to be infringing.
